These Terms of Service ("Terms") govern your use of the Gibby AI WhatsApp Booking System service ("Service") operated by Sentinel Automations ("Sentinel Automations," "we," "us," or "our"). 2. Service Description2. תיאור השירות

Gibby is an AI WhatsApp booking system that helps businesses manage customer conversations and appointment scheduling through the WhatsApp Business Platform. Gibby can respond to customer inquiries, check calendar availability, and prepare or create appointments according to the business configuration.Gibby הוא מערכת WhatsApp AI שעוזרת לעסקים לנהל שיחות עם לקוחות וקביעת תורים דרך פלטפורמת WhatsApp Business. Gibby יכול להשיב לפניות לקוחות, לבדוק זמינות ביומן, ולהכין או לקבוע תורים לפי הגדרות העסק.

The Service is designed to assist — not replace — human decision-making. Final responsibility for business operations, customer relationships, and appointment management rests with the business owner at all times.השירות נועד לסייע — לא להחליף — קבלת החלטות אנושית. האחריות הסופית לתפעול העסק, ליחסי הלקוחות ולניהול התורים מוטלת בכל עת על בעל/ת העסק.

3. Eligibility3. כשירות

To use Gibby as a business owner, you must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your business. Customers interacting with Gibby-powered WhatsApp numbers do so under the terms and policies of the business they are contacting.כדי להשתמש ב־Gibby כבעל/ת עסק, עליכם להיות בני 18 לפחות ובעלי הסמכות המשפטית להתקשר בתנאים אלה בשמכם או בשם העסק שלכם. לקוחות המתקשרים עם מספרי וואטסאפ המופעלים על ידי Gibby עושים זאת בכפוף לתנאים ולמדיניות של העסק שאליו הם פונים.

4. Acceptable Use4. שימוש מותר

You agree to use the Service only for its intended purpose. When using Gibby, you must not:אתם מסכימים להשתמש בשירות אך ורק למטרתו המיועדת. בעת השימוש ב־Gibby, אסור לכם:

• Send spam, unsolicited messages, or bulk promotional content through the Service.לשלוח דואר זבל, הודעות לא רצויות, או תוכן פרסומי המוני דרך השירות.

• AI may make mistakes. Responses generated by Gibby may occasionally be inaccurate, incomplete, or inappropriate. If you are a business owner using Gibby, you are responsible for:אם אתם בעלי עסק המשתמשים ב־Gibby, אתם אחראים ל:

• Ensuring the information provided to Gibby (services, pricing, hours, etc.) is accurate and up to date.להבטיח שהמידע שנמסר ל־Gibby (שירותים, מחירים, שעות וכו') מדויק ומעודכן.
• Monitoring and managing your own appointment calendar.לנטר ולנהל את יומן התורים שלכם.
• Informing your customers that they are interacting with an AI-powered assistant.ליידע את הלקוחות שלכם שהם מתקשרים עם עוזר/ת מבוסס/ת בינה מלאכותית.
• Complying with all applicable laws and regulations relevant to your business and jurisdiction.לציית לכל החוקים והתקנות הרלוונטיים לעסק ולתחום השיפוט שלכם.
• Handling any customer disputes, complaints, or issues arising from bookings or communications.לטפל בכל מחלוקת, תלונה או בעיה של לקוח הנובעת מתורים או מתקשורת.

Sentinel Automations provides the technology platform. We do not manage, oversee, or take responsibility for the day-to-day operations of your business.Sentinel Automations מספקת את פלטפורמת הטכנולוגיה. איננו מנהלים, מפקחים או נושאים באחריות לתפעול היומיומי של העסק שלכם.

7. Limitation of Liability7. הגבלת אחריות

To the maximum extent permitted by applicable law, Sentinel Automations and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total cumulative liability for any claims arising from or related to the Service shall not exceed the amount you have paid us for the Service in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.האחריות המצטברת הכוללת שלנו לכל תביעה הנובעת מהשירות או קשורה אליו לא תעלה על הסכום ששילמתם לנו עבור השירות בשנים־עשר (12) החודשים שקדמו לתביעה, או חמישים דולר אמריקאי (50$), לפי הגבוה מביניהם.

The Service relies on third-party platforms including Meta's WhatsApp Business Platform and Google Calendar. Your use of these platforms is subject to their respective terms of service and policies. All rights, title, and interest in and to the Service — including the software, branding, design, and documentation — are and shall remain the exclusive property of Sentinel Automations. These Terms shall be governed by and construed in accordance with the laws of the State of Israel. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal proceedings in the competent courts of Israel.תנאים אלה יהיו כפופים לדיני מדינת ישראל ויפורשו לפיהם. כל מחלוקת הנובעת מתנאים אלה או מהשירות תיושב באמצעות משא ומתן בתום לב, טרם נקיטת הליכים משפטיים פורמליים בבתי המשפט המוסמכים בישראל.
